01 Fictional content notice

The Realms of Aetheria — including all kingdoms, factions, characters, gods, lore, historical events, and world geography presented within the Services — are entirely fictional. Any resemblance to real persons, living or dead, or to actual events, places, or organisations is purely coincidental.

The game mechanics, rules, cards, spells, creatures, and narrative elements are creative works of fantasy fiction intended solely for entertainment. They do not reflect the views, beliefs, or positions of EnGarde Games UAB on any real-world subject including politics, religion, ethnicity, or conflict.

In-game violence, dark themes, moral ambiguity, and mature storylines are presented in a clearly fantastical context as part of a role-playing and strategy experience. They are not intended to glorify, promote, or instruct real-world harm of any kind.

02 Age & eligibility

• The Services are intended for users aged 13 and above. Users under 13 may only participate with verified parental or guardian consent in accordance with our registration process.
• Certain sections of the platform — including competitive tournament play, community chat, and user-generated story submissions — are recommended for players aged 16 and above due to complex rules and community interaction.
• EnGarde Games UAB reserves the right to verify age upon account creation or at any subsequent time, and to suspend or terminate accounts where age eligibility cannot be confirmed.
• Parents and guardians are encouraged to supervise their minor children's use of the Services and to contact us at support@engarde.lt with any concerns.

03 Virtual goods & no real-money gambling

The Services may include virtual currencies, in-game items, collectible cards, heroes, and other digital assets (collectively, Virtual Goods). You should be aware that:

• Virtual Goods have no real-world monetary value. They cannot be exchanged for real currency, transferred outside the platform, or redeemed for cash or prizes, unless explicitly stated by EnGarde Games UAB in writing.
• Purchases of Virtual Goods are final and non-refundable except where required by applicable consumer protection law. Please refer to our Refund Policy for details.
• Any randomised reward mechanic (card packs, loot drops, etc.) within the Services is not gambling. Outcomes are governed by disclosed probability rates. No real-world monetary prizes are awarded through randomised mechanics.
• EnGarde Games UAB reserves the right to modify, balance, retire, or remove Virtual Goods at any time without compensation, as part of ongoing game maintenance and design.

04 Limitation of liability

To the maximum extent permitted by applicable law:

• The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
• EnGarde Games UAB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the Services, even if we have been advised of the possibility of such damages.
• Our total liability to you for any claim arising under these terms shall not exceed the greater of (a) the amount you paid to us in the twelve months preceding the claim, or (b) €50.
• We do not guarantee that the Services will be error-free, secure, or available at all times. Scheduled and unscheduled maintenance, technical failures, and network disruptions may cause temporary or permanent loss of access.
• We are not responsible for the conduct of other players, including in-game messages, community forum posts, or player-vs-player interactions.

Nothing in this Disclaimer limits or excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by our negligence, or liability for fraud or fraudulent misrepresentation.

05 Accuracy of information

We take reasonable care to ensure that the information on the Services is accurate and up to date. However, we make no representation or warranty — express or implied — that the information is complete, current, or free from errors. In particular:

• Game rules, card stats, lore entries, and world history entries may be updated at any time as part of game balancing and creative development. Published errata take precedence over older card or rulebook text.
• Tournament results, leaderboard rankings, and player statistics are displayed in good faith but may be subject to correction following an official review process.
• News articles and community updates on the site are editorial content and may contain opinions that do not represent the official position of EnGarde Games UAB.

06 Third-party links & services

The Services may contain links to external websites, social media platforms, streaming services (including YouTube and Zeno FM Radio), Discord servers, or other third-party resources. These links are provided for your convenience only.

• EnGarde Games UAB has no control over the content, availability, or privacy practices of third-party sites and accepts no responsibility for them.
• Inclusion of a link does not imply endorsement of the linked site or its operator.
• Your use of any third-party service is subject to that service's own terms of service and privacy policy.

07 Intellectual property

All content on the Services — including but not limited to game art, card designs, world maps, lore text, music, the EnGarde logo, and the Realms of Aetheria setting — is the exclusive intellectual property of EnGarde Games UAB or its licensed contributors, and is protected by Lithuanian and international copyright, trademark, and design law.

• You may not reproduce, distribute, modify, create derivative works from, or publicly display any content from the Services without our express prior written consent.
• Fan art, fan fiction, and community content is permitted for non-commercial personal use only, provided it clearly identifies the work as unofficial and does not damage the EnGarde brand.
• Any feedback, suggestions, or ideas you submit to us may be used by EnGarde Games UAB without obligation or compensation to you.

08 Player conduct disclaimer

EnGarde Games UAB operates an online community and is committed to providing a safe and welcoming environment. However, we cannot guarantee that all player interactions will be positive or appropriate. You use community features at your own discretion.

• We enforce a Community Rules policy and operate a moderation system, but we cannot review every message, post, or interaction in real time.
• If you encounter content that violates our Community Rules, please report it immediately using the in-platform report function or by emailing support@engarde.lt.
• EnGarde Games UAB is not responsible for User-Generated Content (UGC) — including player-submitted stories, characters, or forum posts. UGC reflects the views of the individual author, not of EnGarde Games UAB.

09 Service availability & changes

We reserve the right to:

• Modify, suspend, or permanently discontinue any feature or the entirety of the Services at any time, with or without notice.
• Update this Disclaimer at any time. Material changes will be notified via the website or by email to registered users. Continued use of the Services after such notification constitutes your acceptance of the revised Disclaimer.
• Restrict access to the Services in certain countries or regions to comply with applicable law or platform limitations.

This Disclaimer is governed by the laws of the Republic of Lithuania. Any disputes arising from your use of the Services that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Vilnius, Lithuania, except where mandatory consumer protection law in your country of residence provides otherwise.
